Clerk of Superior Court
The Clerk of Superior Court in North Carolina has four main responsibilities:
Judge; Record Keeper; Administrator; and Comptroller.As the Probate Judge, the Clerk determines what documents meet the legal requirements for a Last Will and Testament and should therefore be admitted to probate. Additionally, the Clerk oversees the administration of family estates, including appointing personal representatives, auditing their accountings, and removing them from office if necessary. The Clerk also presides over many other legal matters including incompetency and guardianship proceedings; foreclosures; partitions of property; legitimations; name changes; adoptions; and many civil hearings as well. As Records Keeper, the Clerk in Alleghany County, North Carolina is responsible for filing, processing, indexing, and maintaining records in the cases filed each year. The Clerk also provides public access to court records and copies of them as well. All records maintained by the Clerk's office in criminal and civil are public records unless law prohibits access to them. A public-access computer terminal is available. As Administrator, the Clerk and employees are responsible for assisting the public in filing and accessing court documents, staffing the courtrooms, and performing the many complex duties required in order to ensure that court records are accurate. Finally, as Comptroller, the Clerk is responsible for receiving and investing the funds each year that come from court fees, traffic citations, fines, etc. The Clerk and staff are dedicated to helping the people of Alleghany county. Office hours are from 8:00 am to 5:00 pm, Monday through Friday.
